How portable long service leave works in Western Australia
- MyLeave says every employer as defined in the Construction Industry Portable Paid Long Service Leave Act 1985 must register with it. Apprentices and workers on a working visa count as eligible workers.
- Registered employers complete a quarterly return, which is sent at the end of each quarter and submitted with payment within a set number of days after the period ends.
- The levy is worked out on each worker's ordinary rate of pay. Ordinary pay and service days are counted by calendar year, not financial year, because the levy can change at the start of each calendar year.
- Employers don't pay the levy for apprentices, but they still include apprentices in their quarterly returns.
- The Minister sets the contribution rate on advice from the MyLeave Board and a report from an actuary. The rate is assessed annually.
- An employer that pays out a long service leave entitlement under another Act or an industrial instrument, and has paid contributions to MyLeave for that worker, can claim a proportionate recovery from MyLeave.
