How it works

Each state and territory has its own long service leave Act. Leave builds up with continuous service with one employer, and becomes available once the employee completes that jurisdiction's full entitlement period.

When employment ends before the full entitlement period, the reason for leaving matters: each Act lists the reasons that pay a proportion of the leave, and other reasons pay nothing. After the full entitlement period, leave is paid on leaving whatever the reason, with some limits after serious misconduct.

Each state and territory's page shows the rules the calculator uses for it.

What the result assumes

  • The employee worked continuously for one employer in one state or territory, and every day in the period counts as service.
  • The employee is covered by the general long service leave Act, not an award, agreement or portable scheme with its own terms.
  • The weeks are before any long service leave already taken.
  • The value uses ordinary weekly pay at the end date for normal hours; varying hours or pay need the Act's averaging, which isn't done here.
  • Whether misconduct meets the relevant Act's test, including wilfulness where required, or a reason was a pressing necessity, is a legal question; the result applies only if the chosen description matches what happened.
  • Not covered: public sector employees, Tasmanian mining employees, Queensland seasonal employees, absences that do not count as service, business transfers or related employers, leave in advance or cashing out, deciding retirement age, or the date leave would end.

Questions about this calculator

Something else on your mind? Ask us directly.

Which states and territories does it cover?
All eight, under each one's general long service leave Act, for the period the rules were checked for.
Why isn't an earlier NSW termination worked out?
NSW Industrial Relations applies its current guidance on part years from the date on the NSW page, and not to earlier cases, so contact NSW Industrial Relations about an earlier termination.
Does it subtract leave already taken?
No. It shows the total before any leave is taken, so subtract any leave already taken.
What if the employee's hours varied?
The calculator uses one ordinary weekly pay figure. Each Act sets its own averaging for varying hours or pay, which the calculator doesn't do.
