How it works
Under the Long Service Leave Act 1976 (Tas), leave builds with continuous service, in the amounts the table below shows. An employee who is still working can take a block of leave once they've served the full entitlement period, and a further block becomes due each time they complete another of the later periods the table shows.
When the job ends with the full entitlement period served, the payment covers all of the employee's service, part years included, whatever the reason for leaving. Between the minimum period and the full entitlement period, a proportion is paid only if the employer ends the employment for a reason other than serious and wilful misconduct, or the employee retires at or after retirement age, resigns because of illness, incapacity or a domestic or other pressing necessity, or dies. Resigning for any other reason, or being dismissed for serious and wilful misconduct, pays nothing before the full period.
A death is worked out its own way. Between the minimum and full periods, the Act pays the share of the whole period of employment shown in the table below, counted in actual days. After the full entitlement period, it pays the leave accrued in completed blocks plus that same share of the days of service since the last completed block.
The rules the calculator uses
| Rule | Value |
|---|---|
| Years of service for a pro rata payment on leaving for a listed reason | 7 years |
| Years of service for the full entitlement | 10 years |
| Leave after 10 years | 8 2/3 weeks |
| Leave for each further 5 years | 4 1/3 weeks |
| Payment on death as a share of the period of employment | 1/60 |

What the result assumes
- Service was unbroken and with a single Tasmanian employer, and every calendar day from the start date to the end date is treated as service.
- The Tasmanian Act governs the employee's leave, rather than an award, enterprise agreement or portable scheme with terms of its own, and the calculator doesn't cover mining employees.
- Leave the employee has already had isn't deducted, so take those weeks away from the result to see the balance.
- Dollar values use ordinary pay for a normal working week as at the end date, and pay or hours that changed over time would need averaging that isn't done here.
- A part year counts as days out of the service year it falls in, and on a death the period is counted in actual days, so a result can differ in the last decimal place from a published example that counts another way.
- The reasons for leaving are a short list matched to the Act's wording, and whether misconduct was serious and wilful or a necessity was pressing is a legal question, so each result holds if this describes what happened.
