Long service leave for part-time employees in Tasmania

In Tasmania, part-time work falls under the Act's general rules rather than rules of its own: employment that is not full-time counts as continuous when the hours test is met, and the Act's definition of an employee reaches anyone employed for hire or reward. Leave pay is based on what the employee would reasonably expect to earn had they kept working through the leave, using normal weekly hours with no overtime.

What it means for your books

  • Whether employment that is not full-time counts as continuous turns on the hours test, whose hours and weeks appear on the page on long service leave for casual employees in Tasmania. Dated weekly hours from the start date give the facts the test is checked against.
  • Overtime is left out of the normal weekly hours, so recording overtime apart from ordinary hours keeps it out of the hours the leave is based on.
  • The expected-earnings measure looks at what the employee would have earned by working on, so current pay rates and normal hours on file, with the dates they last changed, give it a footing. Whether the hours test is met, or what an employee would reasonably expect to earn, is a question for your accountant or WorkSafe Tasmania.
