How it works
Victoria doesn't use a yearly rate. The leave is a share of the employee's total period of continuous employment, and both that share and the qualifying period are in the table below. Once the qualifying period is complete, the employee can take leave while still employed, and the amount keeps growing with each further day of employment.
There's no in-between stage for leaving. If the job ends before the qualifying period is complete, nothing is payable, however it ends. From that point on, the leave is paid out whatever the reason: a resignation, a redundancy, retirement or a dismissal, including one for serious misconduct. When an employee dies, the payment goes to their personal representative.
The share is measured over the actual days employed, from the start date to the end date, leap days included, because the Long Service Leave Act 2018 sets the entitlement against the whole period rather than against counted years.
The rules the calculator uses
| Rule | Value |
|---|---|
| Years of continuous employment before leave is due, or paid on leaving for any reason | 7 years |
| Leave as a share of the total period of continuous employment | 1/60 |

What the result assumes
- All the service was continuous employment with a single employer, inside Victoria.
- Each day between the start and end dates is treated as employment, so absences the Act may exclude aren't subtracted.
- The employee's leave comes from the Victorian Act alone, not from an award, an enterprise agreement or a portable scheme for their industry.
- The result counts every week accrued, so any long service leave the employee has already used still needs to come out of it.
- Its value assumes ordinary weekly pay at the end date for the employee's normal hours; if hours or pay changed over time, the Act's averaging applies and isn't worked out here.
- Workforce Inspectorate Victoria's worked examples count each year as whole weeks, dropping the spare day and any leap day, so their figures run slightly below these, which follow the actual days.
