How it works in Victoria

  • Victoria has no blocks of service. From the qualifying period, leave is the share in the table, stated as a fraction in s 6, of the whole period of continuous employment counted in days, leap days included, so it grows with each further day.
  • There is no pro rata stage in Victoria. When employment ends after the qualifying period, for any reason at all, s 9 has any leave still owing paid out.
  • Leaving before the qualifying period brings no payment under the Act, whatever the reason. That is why this page has no list of reasons that pay early, unlike the other states and territories.
  • When an employee dies after reaching the qualifying period, s 10 has the value of their leave paid to their personal representative.
  • An employee still in the job can take leave from the qualifying period onwards. What is available is the same share of the whole period worked to date, not a set number of weeks for each block.
  • Workforce Inspectorate Victoria's worked examples count each year as whole weeks, which leaves out the odd extra day and any leap day. Their results can therefore sit slightly below a count of every calendar day.
